Indian buyers of Dubai property need to review the funding route, Indian tax residence, overseas income and reporting obligations together. A purchase that is permitted in Dubai can still require banking documentation and disclosures in India. Marketing phrases about low taxation do not answer a particular buyer's cross-border position.
Use this guide to prepare questions for your authorised dealer bank and tax adviser. It explains the issues to resolve rather than prescribing one tax outcome for all Indian citizens.
Distinguish citizenship from residential status
Indian citizenship, Indian income-tax residence and residence under FEMA are different concepts. Establish which rules apply to you for the relevant period. An Indian expatriate and an India-based resident may not use the same funding route or have identical reporting obligations.
The Indian Income Tax Department's current section 5 material explains the scope of taxable income by residence, including overseas income for residents and the narrower treatment applicable to a person who is not ordinarily resident. Have your adviser apply the actual statutory tests to your circumstances. [1]
Owning an apartment or obtaining a UAE residence visa should not be used as a shortcut for that analysis. Your travel history and other relevant facts need review.
Confirm the remittance route before booking
RBI guidance permits a resident individual to use LRS for purchasing overseas immovable property, subject to the scheme's conditions. The published overall limit is USD 250,000 per financial year for eligible remittances, not a separate allowance for every property. [2]
Tell the authorised dealer bank about other remittances already made and all instalments due. Ask what documents establish purpose, source of funds and beneficiary. For joint purchases, obtain advice on ownership shares and each contributor's compliance before combining funds.
Do not assume that bank approval for a Dubai mortgage also makes the proposed overseas borrowing permissible under Indian foreign-exchange rules. Resolve the cross-border financing question separately before relying on a loan.
Budget for India-side cash requirements
Ask the bank and adviser whether tax collection at source applies to your remittance, at what rate and on what base under the rules then in force. Separate an immediate cash requirement from your final tax liability or any credit available through a return.
This guide deliberately does not prescribe a universal TCS rate because the treatment must match the purpose, timing and current rules. Obtain a written transaction estimate before the payment deadline. Include conversion spreads and bank charges as well as the amount received in AED.
Review rental income and sale proceeds
Prepare an annual statement showing rent collected, ownership expenses, financing information and relevant currency conversions. Ask your adviser how Indian house-property rules, deductions and the applicable income classification apply; a Dubai cash-flow spreadsheet is not automatically an Indian taxable-income calculation.
For a future sale, review acquisition records, improvement invoices, ownership shares and the proposed receipt and transfer of proceeds. Confirm the applicable capital-gains and foreign-exchange treatment at that time. Avoid assuming that no Dubai withholding means no reporting or tax elsewhere.
Check foreign-asset disclosures
Income Tax Department guidance covers overseas immovable property in Schedule FA and explains that the schedule is not required for non-residents or persons not ordinarily resident. Its resources also address foreign-source income and relevant reporting schedules. Use the correct return and reporting period for the year being filed. [3]
Store property documents, acquisition dates, contributions, bank advice, rental records and year-end information in an accessible file. Give your adviser the records proactively; the fact that an asset produced no rent does not by itself settle whether disclosure is required.
Avoid an overbroad Dubai tax assumption
The UAE Federal Tax Authority distinguishes qualifying personal real estate investment income from activity conducted, or required to be conducted, through a licence. The ownership structure and activity matter. [4] A holiday-home business, company-held property and an individual's ordinary letting should not automatically receive the same analysis.
Frequently asked questions
Does buying Dubai property remove Indian tax obligations?
No. Your Indian residential status, income and applicable law determine the result. Review property income and disclosures with your adviser. [1]
Can a family combine funds for one purchase?
Ask the authorised dealer bank to approve the actual ownership and remittance arrangement under the applicable conditions. Do not use a family member's limit as an undocumented transfer facility.
What records should I keep from the start?
Signed contracts, registration documents, payment confirmations, source-of-funds evidence, exchange details, expense invoices and subsequent rental statements. A complete trail is easier to maintain than reconstruct later.
